Groups sue to block Biden administration's 'rubber stamp' parent council

A group of conservative activists filed a federal lawsuit seeking to disband a parent council formed by the Department of Education , claiming it was unlawfully constituted.

America First Legal , Parents Defending Education, and Fight for Schools and Families, three conservative organizations, filed a joint lawsuit Wednesday in the U.S. District Court for the District of Columbia seeking to invalidate the National Parents and Families Engagement Council announced by the Department of Education last month on the grounds that the department did not follow the Federal Advisory Committee Act when forming the council.

The council was the subject of harsh criticism from conservative parent activists who claimed the Biden administration had assembled a council of "yes men" to "rubber-stamp their agenda" due to the council's apparent lack of ideological diversity.

The groups claim that, in forming the council, the department violated the Federal Advisory Committee Act, which "mandate[s] viewpoint diversity, open and transparent public meetings and activities, Federal Register notice of its creation, and public oversight." The lawsuit says none of those required actions was followed.

“The facts are clear: the Department of Education has skirted the law and created a partisan cheerleading squad to advance the Biden Administration’s radical agenda at the Department of Education," America First Legal Vice President and General Counsel Gene Hamilton said in a press release. "In so doing, they have violated the Federal Advisory Committee Act and the Administrative Procedure Act, and once again betrayed the trust of American parents who believe in their fundamental right to direct the upbringing and education of their children.”

The council consists of representatives from a number of education organizations that have expressed support for the Biden administration and its policies, including the National Parent Teacher Association, the League of United Latin American Citizens, and the National Action Network, which is led by controversial civil rights activist and MSNBC host the Rev. Al Sharpton.

Nicole Neily, the president and founder of Parents Defending Education, said that the "creation of this rubber-stamp council shows that the Biden Administration is desperately trying to whitewash its flagrant disregard for American parents by pretending to finally listen to families’ concerns."

"Sadly, they’ve merely shown that they really only want to listen to the views of their political allies and not the vast majority of average parents — which has become a pattern and practice for this group of ideologically-motivated activists," Neily said.

Ian Prior, the executive director of the political action committee Fight for Schools and Families, likewise ripped the council.

"This new ‘parents council’ is nothing more than a public relations mirage, behind which are the same cabal of activist groups that created the very problems that parents have been working to fix at the local level," Prior said. "We’re not fooled and neither will the parents that wake up every day ready to fight for their children."
